I get a similar error message when I click on 'view sanity check'.
I am using Vista. At first I couldn't even save files in the gmax/Scenes directory where it wants to save the files. The really bad thing was that I didn't even get a message that the file couldn't be saved.
I only found out when it wasn't there.

If you want to save files into that directory, you have to give yourself access rights to that directory. You don't have access to a directory of a program that you installed yourself without giving yourself that access. That's Vista (and probably windows 7, too) for you.
The sanity check file also can't be saved because of wrong access rights. I don't know where the file is supposed to be saved to, so I haven't given myself access rights to that directory yet.
I always use a workaround. Instead of clicking on 'view sanity check', I press F11 which opens the max script listener which also shows the results of the sanity check.
