               Can i use coummuntiy made content for commerical uses?I plan on creating a game useing the unreal editor 3.

Nope,  Legally, there is no such thing as 'community content' as it is all technically owned by Bioware, read your EULA for clarification.   Bioware explicitly states NO to doing anything for money with regards to NWN content.

Beyond that, you would have to seek permission from anyone that created the content and once you mention that you are creating somethign for profit, you would end up having to pay for that content IF Bioware gave up their own rights to it.

Actually the EULA specifically refers to "derivative works", and while there's been some debate, most artists I've spoken to consider this to refer to either works based on or containing existing game content or created using the provided tools, as the wide scope of the nature of entirely original 3d art content cannot reasonably be laid claim to by anyone but the artist who has created it. Though I don't want to start any kind of debate on this point.

Either way, no, you cannot legally use assets from NWN or made by community authors without both the permission of all relevant parties, likely including Bioware, in a non-NWN project whether commercial or not.

               But if someones creating a model in 3dmax and they made it from scracth...I dont see how bioware or whoever could have a say in the matter other then that it appears in there nwnvault and was released there.See what im saying?Im most likely intersted in some gun models and a few creatures that appear in cep.

               If someone could also point out the size of a male human exported from 3dmax it would help me in designing my layout for my world since id like to use the same camera seetings and scale involved with nwn.I want to basicly have the same layout size because im used to it when building areas and i need to do that to my map in unreal...size it up.

You started this thread with the question of whether or not you could use SOMEONE ELSE's content, and the answer is that legally you can not!

As to the bit about it being your content, to get it into the game, you have to modify it to fit the nwn engine, and use the tools provided by bioware (regardless of who else modified those tools) to make it work in NWN.  So... the intent was to make the creature, tile, placeable, whatever, a piece of content that would work with NWN.  Which leaves the door open for Bioware to claim copyright and does not negate any copyright of the author that created the content, which is another issue as well.

There have been serveral 'wars' on this issue in the past.  So far, no one has been taken to court, but if folks keep stealing content, Most especially for use in another game, where you are making money from it all, I would expect that to change.

               Ok but do you know the size when exporting from 3dmax i still need to design my maps the same perspetive or map size for me to be comfortable in this new toolset.I mean theres a size in there somewhere right.....in 3dmax when your viewing or exporting a human pc model?



I guess ill have to deal with it being biowares models just for the sake not haveing to deal with legal issues down the road.Even though i still totaly agree with it at all.

               For what it's worth, IIRC the male and female NWN human character models in neutral position are both around 1.9 metres tall. Bearing in mind that theyre essentially stretch full and on tiptoe in that position and considering the differing animation sets, that puts their heights at around 1.8 and 1.6 metres respectively, which is roughly in line with average actual heights.
