You started this thread with the question of whether or not you could use SOMEONE ELSE's content, and the answer is that
legally you can not!
As to the bit about it being your content, to get it into the game, you have to modify it to fit the nwn engine, and use the tools provided by bioware (regardless of who else modified those tools) to make it work in NWN. So... the intent was to make the creature, tile, placeable, whatever, a piece of content that would work with NWN. Which leaves the door open for Bioware to claim copyright and does not negate any copyright of the author that created the content, which is another issue as well.
There have been serveral 'wars' on this issue in the past. So far, no one has been taken to court, but if folks keep stealing content, Most especially for use in another game, where you are making money from it all, I would expect that to change.
